1. Introduction

Welcome to Mushrooms-Australia.

These Terms and Conditions govern your access to and use of the Mushrooms-Australia website, online store, products, services, content and related features.

By accessing, browsing or using our website, or by placing an order through our online store, you agree to comply with these Terms and Conditions to the extent they apply to you.

Please read these Terms and Conditions carefully before using our website or placing an order.

If you do not agree with these Terms and Conditions, you should not use the website or place an order through it.

These Terms and Conditions are intended to establish a clear and professional understanding between Mushrooms-Australia and our customers regarding website use, ordering, payments, delivery, returns, customer responsibilities, intellectual property, privacy, liability and other matters relevant to our online business.

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any right, guarantee, remedy or protection that cannot lawfully be excluded, restricted or modified under Australian law.

The Australian Consumer Law (ACL) provides consumers with automatic consumer guarantees when they purchase goods and services. Those guarantees cannot be removed by a business’s terms and conditions.

3. Acceptance of These Terms

3.1 Website Use

By accessing our website, you confirm that you have read and understood these Terms and Conditions and agree to comply with them.

Your use of the website may also be subject to:

  • our Privacy Policy;

  • applicable product-specific information;

  • delivery information;

  • returns and refund procedures;

  • payment-provider terms;

  • applicable Australian laws; and

  • any additional terms displayed at the time of purchase.

3.2 Online Orders

When you submit an order, you are making a request to purchase the relevant product or service under the terms displayed at the time of purchase.

An order is not necessarily accepted merely because you have received an automated order acknowledgement.

We may need to verify information before accepting an order.

Where an order is accepted, the relevant purchase contract will be governed by these Terms and Conditions together with any specific terms applying to the relevant product or service.

4. Eligibility to Use Our Website

You must use our website only where you are legally permitted to do so.

By using the website or placing an order, you represent that:

  • the information you provide is accurate;

  • you have authority to enter into any transaction you make;

  • you will comply with applicable laws;

  • you will not use the website for unlawful purposes;

  • you will not attempt to interfere with website security;

  • you will not misuse our website or services; and

  • you will comply with any applicable age, product or purchasing restrictions.

Certain products may have additional eligibility requirements.

Where a product is subject to an age restriction or other legal requirement, we may require appropriate verification before completing an order.

5. Legal Compliance

Mushrooms-Australia operates with an expectation that customers and visitors will comply with applicable Australian laws.

Products displayed on our website are intended to be supplied only where the relevant sale, possession, use and delivery are lawful.

5.1 Prohibited Transactions

You must not use our website to:

  • purchase products for an unlawful purpose;

  • facilitate unlawful activity;

  • misrepresent your identity;

  • provide false information;

  • circumvent legal restrictions;

  • interfere with regulatory requirements;

  • attempt to obtain restricted products unlawfully;

  • resell products in breach of applicable laws;

  • misuse our website or payment systems; or

  • engage in fraudulent or deceptive activity.

Mushrooms-Australia reserves the right to decline or cancel an order where we reasonably believe the transaction may breach applicable law or our legitimate compliance requirements.

5.2 Changes in Applicable Law

Laws and regulations can change.

A product or service that is available at one time may subsequently become subject to restrictions, requirements or other legal considerations.

We may modify, suspend or remove a product or service where reasonably necessary to comply with applicable law.

6. Website Information

We aim to provide accurate, useful and current information on our website.

However, product descriptions, images, specifications, availability, pricing and other information may occasionally contain errors or require updating.

Where we identify a material error, we may correct the relevant information.

We do not intend to make false or misleading representations about our products or services.

The Australian Consumer Law prohibits misleading or deceptive conduct and requires businesses to provide truthful information about goods and services.

7. Product Information

7.1 Product Descriptions

We endeavour to describe products accurately.

Product information may include:

  • product name;

  • description;

  • quantity;

  • size;

  • ingredients or materials where applicable;

  • cultivation information;

  • usage information where appropriate;

  • storage information;

  • photographs;

  • price;

  • availability; and

  • other relevant details.

Minor differences may occur between website photographs and the actual appearance of a product due to photography, lighting, screen settings, packaging changes or natural variation.

7.2 Natural Products

Where products contain natural or cultivated materials, some variation may occur.

Natural products can vary in:

  • appearance;

  • colour;

  • shape;

  • size;

  • texture;

  • aroma; and

  • other physical characteristics.

Such variations do not necessarily indicate a defect.

However, nothing in this section limits any rights you may have under the Australian Consumer Law.

8. Product Availability

Products displayed on our website are subject to availability.

We may update stock levels from time to time.

If a product becomes unavailable after an order has been submitted, we will contact you where appropriate and provide an available solution.

Depending on the circumstances, this may include:

  • waiting for stock to become available;

  • selecting an alternative product;

  • receiving a refund; or

  • cancelling the affected portion of the order.

We will not intentionally accept payment for products that we do not intend to supply.

Australian consumer law places obligations on businesses concerning goods or services paid for by consumers.

9. Pricing

Prices displayed on our website are presented in Australian dollars unless otherwise stated.

Prices may change from time to time.

A price displayed on a product page may not necessarily constitute acceptance of an order.

Where applicable, the final price payable will be displayed during the checkout process before the customer completes the transaction.

9.1 Pricing Errors

Although we take reasonable steps to ensure accurate pricing, an obvious pricing error may occasionally occur.

If an order contains a material pricing error, we may contact you before processing the order.

We will seek to deal with such situations fairly and transparently.

Nothing in this section is intended to remove or restrict rights available under Australian law.

10. Orders

10.1 Placing an Order

When placing an order, you should ensure that:

  • your name is accurate;

  • your email address is correct;

  • your delivery address is complete;

  • your payment information is accurate;

  • you have selected the correct products;

  • quantities are correct; and

  • you have reviewed the total amount payable.

Once an order has been submitted, changes may not always be possible.

10.2 Order Acknowledgement

You may receive an automated email acknowledging receipt of your order.

An acknowledgement confirms that we have received your order request but does not necessarily mean that the order has been accepted.

An order may remain subject to availability, payment verification, legal requirements and other reasonable checks.

10.3 Order Acceptance

Where we accept your order, the relevant transaction will proceed in accordance with these Terms and Conditions and any product-specific terms presented during checkout.

We may decline an order where reasonably necessary, including where:

  • a product is unavailable;

  • payment cannot be verified;

  • information is materially incorrect;

  • there is a suspected fraudulent transaction;

  • delivery is unavailable;

  • the transaction may breach applicable law;

  • an order contains an obvious pricing error; or

  • another legitimate operational or legal reason applies.

Where payment has already been taken for an order that we cannot fulfil, we will consider the appropriate refund or other remedy in accordance with applicable law.

11. Customer Information

Customers are responsible for providing accurate information.

This includes:

  • full name;

  • email address;

  • delivery address;

  • billing information;

  • contact details;

  • order information; and

  • any other information reasonably required to process the transaction.

Incorrect information may result in delays or unsuccessful delivery.

We will handle personal information in accordance with our Privacy Policy.

12. Payment

We may provide one or more payment methods through our website.

Available payment methods may change over time.

Payment processing may be handled by third-party payment providers.

Where a third-party provider processes your payment, that provider’s own terms and privacy policy may also apply.

You must use a payment method that you are authorised to use.

You must not:

  • use another person’s payment method without authorisation;

  • provide fraudulent payment details;

  • attempt to circumvent payment controls;

  • initiate fraudulent chargebacks;

  • interfere with payment processing; or

  • provide knowingly inaccurate payment information.

We may delay or cancel an order where payment cannot be verified or where a transaction raises reasonable fraud or security concerns.

13. Delivery

Mushrooms-Australia aims to provide reliable delivery options within Australia where delivery is legally available.

Our current estimated delivery timeframe is:

24–48 hours.

This timeframe is an estimate and may vary depending on circumstances outside our reasonable control.

13.1 Possible Delivery Delays

Delivery may be affected by:

  • courier delays;

  • public holidays;

  • weekends;

  • severe weather;

  • incorrect delivery information;

  • remote delivery locations;

  • transport interruptions;

  • operational disruptions;

  • security or verification requirements;

  • events outside our reasonable control; or

  • other circumstances affecting the delivery network.

We will endeavour to communicate significant delays where reasonably possible.

13.2 Delivery Address

Customers must provide an accurate and complete delivery address.

We are not responsible for delays resulting solely from inaccurate information supplied by the customer, subject to any rights the customer may have under Australian law.

13.3 Delivery Tracking

Where tracking is available through the relevant delivery service, tracking information may be provided to the customer.

Tracking information is supplied by the delivery provider and may not update immediately.

14. Delivery Restrictions

We may restrict delivery of particular products or orders where:

  • applicable law prohibits delivery;

  • the destination is outside our service area;

  • the product cannot lawfully be supplied to the destination;

  • a delivery provider will not accept the relevant shipment;

  • additional verification is required; or

  • another legitimate legal or operational restriction applies.

Customers are responsible for ensuring that the purchase, possession and use of a product are lawful in their location.

Mushrooms-Australia does not encourage customers to circumvent Australian or other applicable laws.

15. Consumer Guarantees

Nothing in these Terms and Conditions excludes, restricts or modifies consumer guarantees that apply under the Australian Consumer Law.

Where the ACL applies, goods and services must meet applicable consumer guarantees.

Depending on the circumstances, consumer guarantees may include requirements relating to:

  • acceptable quality;

  • fitness for a disclosed purpose;

  • correspondence with description;

  • matching samples or demonstrations;

  • title and ownership;

  • services being provided with due care and skill;

  • services being fit for a particular purpose; and

  • services being supplied within a reasonable time where no timeframe has been agreed.

The appropriate remedy depends on the circumstances and whether the issue constitutes a major or minor failure.

The ACCC confirms that consumer guarantees are automatic and cannot be removed by a business’s terms and conditions.

16. Australian Consumer Law Mandatory Notice

16.1 Consumer Guarantees for Goods

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

16.2 Consumer Guarantees for Services

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and

  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

These mandatory consumer guarantee statements are based on the wording published by the ACCC.

17. Returns and Refunds

We aim to handle returns and refund requests fairly and consistently.

A return, replacement, repair or refund may be available where required by Australian Consumer Law or under any additional return policy we voluntarily provide.

17.1 Products With a Problem

If you believe a product has a fault, defect or other issue, contact us as soon as reasonably possible.

Please provide:

  • your name;

  • order number;

  • product name;

  • description of the problem;

  • date the problem was noticed;

  • photographs where useful; and

  • any other relevant information.

We may request reasonable information to assess the issue.

17.2 Major Failure

Where a product has a major failure under the ACL, you may have the right to choose an appropriate remedy, which may include a refund, replacement or other remedy available under law.

17.3 Minor Failure

Where a product has a minor failure, the appropriate remedy may include repair or replacement within the circumstances prescribed by law.

We will assess each issue based on its circumstances and applicable legal requirements.

18. No Blanket “No Refund” Policy

Mushrooms-Australia does not intend these Terms and Conditions to operate as a blanket “no refunds” policy.

A business cannot remove statutory consumer guarantees by simply stating that refunds are unavailable.

Where the Australian Consumer Law provides a right to a refund, replacement, repair, cancellation or compensation, that right remains available.

The ACCC specifically warns that businesses cannot use “no refunds” statements to take away consumer guarantee rights.

19. Change-of-Mind Returns

A change-of-mind return is different from a product that fails to meet a consumer guarantee.

Unless otherwise stated or required by law, we are not required to accept a return merely because a customer changes their mind.

However, if Mushrooms-Australia offers a voluntary change-of-mind return policy for a particular product, the relevant conditions will be displayed with that offer.

Nothing in this section limits statutory consumer rights.

20. Product Storage and Handling

Customers should follow any storage, handling or care instructions supplied with a product.

Where relevant, customers should:

  • follow the product label;

  • observe storage requirements;

  • keep products away from children;

  • keep products away from animals where appropriate;

  • avoid contamination;

  • use suitable storage conditions; and

  • follow any safety instructions provided.

Mushrooms-Australia cannot be responsible for problems caused by inappropriate storage, handling or use after delivery where the problem is not attributable to a failure of the product or service.

This does not limit any applicable consumer guarantee.

21. Product Information Is Not Medical Advice

Information appearing on our website should not automatically be treated as medical, therapeutic, diagnostic or professional advice.

Product descriptions and educational material are provided for general information unless expressly stated otherwise.

You should obtain advice from a suitably qualified professional where you require medical, dietary, therapeutic, health or other professional guidance.

Do not rely on general website information as a substitute for advice appropriate to your personal circumstances.

22. Lawful Use of Products

Customers are responsible for using products in accordance with applicable laws and any relevant product instructions.

You must not use products supplied by Mushrooms-Australia for unlawful purposes.

Where products are subject to specific legal restrictions, age restrictions, possession requirements, cultivation requirements or other regulatory conditions, customers are responsible for understanding and complying with those requirements.

Mushrooms-Australia does not provide legal advice about the laws applicable to your particular circumstances.

23. Website Content

All website content is provided for general information and commercial purposes.

Content may include:

  • product descriptions;

  • photographs;

  • written articles;

  • educational resources;

  • graphics;

  • logos;

  • branding;

  • product information;

  • website navigation;

  • videos;

  • downloadable materials; and

  • other content.

We aim to keep website content reasonably accurate and current but do not guarantee that every item of information will always be complete or free from errors.

24. Intellectual Property

Unless otherwise stated, intellectual property appearing on the Mushrooms-Australia website is owned by or licensed to Mushrooms-Australia or its relevant content provider.

This may include:

  • business names;

  • logos;

  • trademarks;

  • photographs;

  • graphics;

  • text;

  • product descriptions;

  • website design;

  • layout;

  • original educational content;

  • videos;

  • downloadable resources; and

  • other original materials.

You must not reproduce, copy, modify, distribute, publish, sell, licence or commercially exploit our content without appropriate permission.

You may use the website for legitimate personal or business purposes consistent with these Terms and Conditions and applicable law.

25. User-Submitted Content

If we permit customers to submit reviews, comments, photographs, testimonials or other material, you must ensure that your submission:

  • is accurate to the best of your knowledge;

  • does not contain unlawful material;

  • does not infringe another person’s rights;

  • does not contain malicious software;

  • does not disclose another person’s private information without permission;

  • is not defamatory;

  • is not misleading;

  • does not impersonate another person; and

  • does not violate applicable law.

We may moderate or remove content where reasonably necessary, including where content violates these Terms and Conditions or applicable law.

26. Website Security

You must not attempt to compromise or interfere with the security or operation of our website.

Prohibited activities include:

  • unauthorised access;

  • attempting to access restricted systems;

  • introducing malicious code;

  • distributing malware;

  • interfering with website availability;

  • scraping information in a manner that unreasonably burdens our systems;

  • conducting denial-of-service activity;

  • bypassing security controls;

  • attempting to obtain another user’s account credentials; or

  • otherwise interfering with the normal operation of the website.

We may restrict or suspend access where we reasonably believe that security has been compromised or these Terms have been breached.

27. Prohibited Website Use

You must not use our website:

  • for unlawful activities;

  • for fraudulent transactions;

  • to impersonate another person;

  • to provide false information;

  • to infringe intellectual property rights;

  • to harass or threaten others;

  • to distribute malicious software;

  • to interfere with website functionality;

  • to collect personal information without authority;

  • to attempt unauthorised access;

  • to circumvent security measures; or

  • in any manner that could reasonably damage Mushrooms-Australia, its customers or its service providers.

28. Third-Party Services

Our website may use third-party services, including providers involved in:

  • payments;

  • hosting;

  • website technology;

  • analytics;

  • communications;

  • email;

  • delivery;

  • customer support;

  • fraud prevention; and

  • other business operations.

Third-party providers may have their own terms and conditions.

Where you use a third-party service, you may also be bound by that provider’s terms.

Mushrooms-Australia is not responsible for terms that are independently imposed by third-party providers, although we will endeavour to work with reputable providers appropriate to the relevant business function.

29. Third-Party Links

Our website may contain links to external websites.

These links may be provided for convenience, education or additional information.

We do not necessarily control or endorse the content, products, services, security or privacy practices of third-party websites.

You should review the terms and privacy policies of external websites before using them or submitting personal information.

30. Privacy

Your use of our website may involve the collection and handling of personal information.

Our Privacy Policy explains how Mushrooms-Australia collects, uses, holds, discloses and protects personal information.

Our Privacy Policy should be read together with these Terms and Conditions.

Where applicable, personal information is handled in accordance with Australian privacy requirements and the privacy practices described in our Privacy Policy.

31. Account Security

If our website allows you to create an account, you are responsible for protecting your login credentials.

You should:

  • use a unique password;

  • avoid sharing your password;

  • log out of shared devices;

  • keep your contact details current;

  • notify us if you suspect unauthorised access; and

  • avoid using credentials that are easily guessed.

You must not knowingly allow another person to use your account in breach of these Terms and Conditions.

32. Suspension or Termination

We may suspend or restrict access to the website where reasonably necessary, including where:

  • the website requires maintenance;

  • a security issue is detected;

  • a user breaches these Terms;

  • unlawful activity is suspected;

  • fraudulent activity is suspected;

  • a legal requirement applies; or

  • another legitimate operational reason exists.

Where appropriate, we will endeavour to minimise disruption.

Termination or suspension does not remove rights that have already accrued under applicable law.

33. Force Majeure

We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, to the extent permitted by law.

Such circumstances may include:

  • severe weather;

  • natural disasters;

  • fire;

  • flood;

  • infrastructure failure;

  • telecommunications failure;

  • courier disruption;

  • major technical failures;

  • industrial action;

  • government action;

  • changes in law;

  • public emergencies;

  • cyber incidents;

  • power outages; or

  • other events beyond our reasonable control.

Where such circumstances occur, we will endeavour to resume normal operations as soon as reasonably practicable.

Nothing in this section excludes statutory rights that cannot lawfully be excluded.

34. Limitation of Liability

To the maximum extent permitted by law, Mushrooms-Australia is not responsible for loss caused by circumstances outside our reasonable control.

However, nothing in these Terms and Conditions excludes, restricts or modifies liability that cannot lawfully be excluded, restricted or modified.

Where Australian Consumer Law applies, statutory consumer guarantees remain unaffected.

We do not seek to contract out of consumer guarantees or other mandatory protections.

35. Consequential Loss

To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of our website or products where that loss is not attributable to a breach of an applicable consumer guarantee or other non-excludable legal obligation.

This may include, where legally permissible:

  • loss of opportunity;

  • loss of anticipated savings;

  • loss of business;

  • loss of revenue;

  • loss of data; or

  • other indirect losses.

This provision is subject to any rights that cannot lawfully be excluded.

36. Indemnity

To the extent permitted by law, you agree to take responsibility for losses or claims arising directly from your unlawful use of our website, fraud, intentional misuse, or breach of these Terms and Conditions.

This does not require you to indemnify Mushrooms-Australia for matters caused by our own unlawful conduct, negligence or obligations that cannot legally be transferred to you.

Nothing in this section is intended to create an unfair contract term.

Australian law provides protections against unfair terms in standard-form consumer and small-business contracts.

37. Fair and Transparent Contract Terms

Mushrooms-Australia aims to keep these Terms and Conditions reasonably clear, transparent and understandable.

We do not intend to rely on provisions that unlawfully create a significant imbalance between the parties or cause consumers or protected small businesses unfair harm.

Australian law prohibits the use of unfair terms in certain standard-form contracts, and a court may determine whether a particular term is unfair.

If a provision of these Terms is found to be unenforceable or unfair, the remaining provisions should continue to operate to the extent legally possible.

38. Changes to These Terms

We may update these Terms and Conditions from time to time.

Reasons for an update may include:

  • changes to our products;

  • changes to website functionality;

  • changes to delivery arrangements;

  • changes to payment methods;

  • changes to applicable law;

  • changes to our business operations;

  • security improvements;

  • customer feedback; or

  • other legitimate business requirements.

The updated version will be published on our website where appropriate.

The “Last updated” date at the beginning of this document indicates when the current version was last updated.

39. Six-Month Review

Mushrooms-Australia intends to review these Terms and Conditions every six months.

Current update: 1 June 2026

Next scheduled review: 1 December 2026

Review cycle: Every six months

A review may occur earlier where a material change to our business, products, website, legal obligations or operating practices makes an earlier review appropriate.

40. Complaints and Customer Support

If you have a concern about an order, product, delivery, payment or website experience, we encourage you to contact us directly.

  • your name;

  • order number, if applicable;

  • relevant dates;

  • details of the issue;

  • photographs or supporting documents where relevant; and

  • the outcome you are seeking.

We will assess complaints fairly and aim to provide a practical response.

41. Dispute Resolution

We encourage customers to contact Mushrooms-Australia first if they have a dispute.

Where appropriate, we will attempt to resolve the issue through direct communication.

Depending on the nature of the dispute, available remedies may include:

  • correction of an error;

  • replacement;

  • repair;

  • refund;

  • cancellation;

  • further investigation; or

  • another remedy required or permitted by law.

Nothing in this section prevents a customer from exercising a legal right or contacting an appropriate regulator or dispute-resolution body.

42. Australian Consumer Protection

Mushrooms-Australia recognises that customers in Australia are protected by applicable consumer laws.

The Australian Consumer Law applies to businesses selling goods and services in Australia and provides consumer guarantees that cannot simply be removed through website terms.

Accordingly:

  • our Terms do not replace statutory consumer guarantees;

  • our Terms do not create a blanket “no refund” policy;

  • our Terms do not authorise misleading conduct;

  • our Terms do not permit unfair contract terms;

  • our Terms do not prevent customers from exercising legal rights; and

  • any voluntary warranty we provide operates in addition to applicable consumer guarantees.

43. Warranties

Where Mushrooms-Australia provides an express warranty, that warranty will be subject to the specific terms provided with the relevant product or service.

A voluntary warranty does not replace Australian Consumer Law guarantees.

Consumer guarantees may apply independently of any voluntary warranty.

The ACCC confirms that warranties are additional promises and cannot remove or replace statutory consumer guarantees.

44. Website Availability

We aim to keep our website available and functioning properly.

However, we do not guarantee uninterrupted availability.

The website may occasionally be unavailable due to:

  • maintenance;

  • upgrades;

  • technical faults;

  • hosting issues;

  • security measures;

  • software updates;

  • telecommunications interruptions;

  • power failures; or

  • other circumstances outside our reasonable control.

Where practical, we will endeavour to restore affected services promptly.

45. Website Accuracy and Updates

Website information can change.

We may update:

  • product descriptions;

  • prices;

  • stock information;

  • images;

  • delivery information;

  • website content;

  • policies;

  • availability; and

  • other information.

We aim to ensure that material information is accurate at the time it is published.

If an error materially affects an order, we will seek to address it fairly and in accordance with applicable law.

46. Electronic Communications

When you communicate with Mushrooms-Australia electronically, you consent to receiving electronic responses where appropriate.

This may include:

  • order confirmations;

  • invoices;

  • delivery updates;

  • customer-service responses;

  • account notices;

  • security notifications;

  • policy updates; and

  • other transactional communications.

Electronic communications do not prevent you from exercising statutory rights.

Marketing communications are subject to applicable privacy and electronic marketing requirements.

47. Notices

Where we need to provide you with a notice concerning your order, account or use of the website, we may communicate through:

  • email;

  • website notices;

  • account notifications;

  • other electronic communications; or

  • another reasonable communication method.

You are responsible for ensuring that the email address associated with your account or order is accurate.

48. Assignment

You must not transfer your rights or obligations under an order or these Terms and Conditions to another person without our prior written agreement, except where permitted by law.

Mushrooms-Australia may transfer or assign relevant business rights where reasonably necessary as part of a legitimate business restructuring, sale, merger or other corporate transaction, subject to applicable law and any rights you may have.

49. Severability

If a court or competent authority determines that any provision of these Terms and Conditions is invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary where legally possible.

If it cannot be modified, it may be removed without affecting the remaining provisions.

The remainder of these Terms and Conditions will continue to operate to the extent permitted by law.

50. Waiver

If Mushrooms-Australia does not immediately enforce a provision of these Terms and Conditions, that does not necessarily mean that we have permanently waived the right to enforce it.

A waiver must be understood in its particular circumstances and does not automatically apply to future breaches.

Nothing in this provision overrides mandatory rights or protections under Australian law.

51. Entire Agreement

These Terms and Conditions, together with any applicable product-specific terms, order information, Privacy Policy and other policies expressly incorporated into the transaction, represent the relevant terms governing your use of our website and purchases from Mushrooms-Australia, subject to applicable law.

Where there is an inconsistency between these Terms and a mandatory legal requirement, the legal requirement will prevail.

Where a specific product or service has additional terms, those terms may apply to the extent they are clearly provided and legally enforceable.

52. Governing Law

These Terms and Conditions are intended to be governed by the laws applicable in Australia.

Where a particular matter is governed by a state or territory law, the applicable jurisdictional requirements will apply.

Mushrooms-Australia operates from:

217 Coorabell Road, Coorabell, Byron Bay, Australia.

Nothing in this section is intended to deprive a consumer of any mandatory protection available under the law applicable to their transaction.

53. Jurisdiction

Subject to applicable law, disputes concerning these Terms and Conditions or transactions with Mushrooms-Australia may be dealt with by courts or tribunals having appropriate jurisdiction.

Nothing in this section prevents a customer from exercising rights available under Australian consumer law or other mandatory legislation.

54. Privacy and Personal Information

Our handling of personal information is governed by our Privacy Policy.

The Privacy Policy explains matters including:

  • what personal information we collect;

  • why we collect it;

  • how we use it;

  • who may receive it;

  • how we protect it;

  • how long we may retain it;

  • access and correction requests;

  • privacy complaints; and

  • relevant overseas disclosure arrangements.

Customers should review our Privacy Policy before submitting personal information through the website.

55. Customer Responsibility

Customers are expected to act reasonably and honestly when interacting with Mushrooms-Australia.

This includes:

  • providing accurate information;

  • using lawful payment methods;

  • following product instructions;

  • providing accurate delivery details;

  • complying with applicable laws;

  • respecting intellectual property;

  • protecting account credentials;

  • communicating respectfully with staff; and

  • promptly notifying us of relevant problems.
